New rules aim to get rid of junk foods in schools

(AP) ? Most candy, high-calorie drinks and greasy meals could soon be on a food blacklist in the nation's schools.

For the first time, the government is proposing broad new standards to make sure all foods sold in schools are more healthful.

Under the new rules the Agriculture Department proposed Friday, foods like fatty chips, snack cakes, nachos and mozzarella sticks would be taken out of lunch lines and vending machines. In their place would be foods like baked chips, trail mix, diet sodas, lower-calorie sports drinks and low-fat hamburgers.

The rules, required under a child nutrition law passed by Congress in 2010, are part of the government's effort to combat childhood obesity. While many schools already have improved their lunch menus and vending machine choices, others still are selling high-fat, high-calorie foods.

Under the proposal, the Agriculture Department would set fat, calorie, sugar and sodium limits on almost all foods sold in schools. Current standards already regulate the nutritional content of school breakfasts and lunches that are subsidized by the federal government, but most lunchrooms also have "a la carte" lines that sell other foods. Food sold through vending machines and in other ways outside the lunchroom has never before been federally regulated.

"Parents and teachers work hard to instill healthy eating habits in our kids, and these efforts should be supported when kids walk through the schoolhouse door," Agriculture Secretary Tom Vilsack said.

Most snacks sold in school would have to have less than 200 calories. Elementary and middle schools could sell only water, low-fat milk or 100 percent fruit or vegetable juice. High schools could sell some sports drinks, diet sodas and iced teas, but the calories would be limited. Drinks would be limited to 12-ounce portions in middle schools and to 8-ounce portions in elementary schools.

The standards will cover vending machines, the "a la carte" lunch lines, snack bars and any other foods regularly sold around school. They would not apply to in-school fundraisers or bake sales, though states have the power to regulate them. The new guidelines also would not apply to after-school concessions at school games or theater events, goodies brought from home for classroom celebrations, or anything students bring for their own personal consumption.

The new rules are the latest in a long list of changes designed to make foods served in schools more healthful and accessible. Nutritional guidelines for the subsidized lunches were revised last year and put in place last fall. The 2010 child nutrition law also provided more money for schools to serve free and reduced-cost lunches and required more meals to be served to hungry kids.

Sen. Tom Harkin, D-Iowa, has been working for two decades to take junk foods out of schools. He calls the availability of unhealthful foods around campus a "loophole" that undermines the taxpayer money that helps pay for the healthier subsidized lunches.

"USDA's proposed nutrition standards are a critical step in closing that loophole and in ensuring that our schools are places that nurture not just the minds of American children but their bodies as well," Harkin said.

Last year's rules faced criticism from some conservatives, including some Republicans in Congress, who said the government shouldn't be telling kids what to eat. Mindful of that backlash, the Agriculture Department exempted in-school fundraisers from federal regulation and proposed different options for some parts of the rule, including the calorie limits for drinks in high schools, which would be limited to either 60 calories or 75 calories in a 12-ounce portion.

The department also has shown a willingness to work with schools to resolve complaints that some new requirements are hard to meet. Last year, for example, the government relaxed some limits on meats and grains in subsidized lunches after school nutritionists said they weren't working.

Schools, the food industry, interest groups and other critics or supporters of the new proposal will have 60 days to comment and suggest changes. A final rule could be in place as soon as the 2014 school year.

Margo Wootan, a nutrition lobbyist for the Center for Science in the Public Interest, said surveys by her organization show that most parents want changes in the lunchroom.

"Parents aren't going to have to worry that kids are using their lunch money to buy candy bars and a Gatorade instead of a healthy school lunch," she said.

The food industry has been onboard with many of the changes, and several companies worked with Congress on the child nutrition law two years ago. Major beverage companies have already agreed to take the most caloric sodas out of schools. But those same companies, including Coca-Cola and PepsiCo, also sell many of the non-soda options, like sports drinks, and have lobbied to keep them in vending machines.

A spokeswoman for the American Beverage Association, which represents the soda companies, says they already have greatly reduced the number of calories that kids are consuming at school by pulling out the high-calorie sodas.

Oregon car-bomber found guilty of terrorism

PORTLAND, Ore. (AP) ? Three hours before they handed down a sentence that could put an Oregon man in prison for life, deliberating jurors sent a note to a trial judge with a question.

Did the man whose fate they were deciding need to have envisioned the specific crime for which he was accused? Or did he merely need to be inclined toward some kind of terroristic act?

Their question more broadly reflects the central debate at the heart of the trial of Mohamed Mohamud, a 21-year-old Somali-American found guilty on Thursday of attempting to bomb a Portland Christmas tree-lighting in November 2010.

Prosecutors were met by a claim of entrapment by Mohamud's defense team, and needed to convince jurors that he was predisposed to terrorism by the time an FBI informant began discussing radical jihad with him over emails.

The judge, Garr King, told jurors Thursday that Mohamud only had to be likely to commit the offense or one like it, and he did not specifically have to be thinking about a bomb at the specific time and place at which he and two undercover FBI agents decided to plant one.

The bomb was a fake, supplied by the agents posing as jihadis.

Jurors were given starkly different portraits of the man who was 17 when the FBI began to focus on him. In the prosecution's description, Mohamud was a powder keg in search of a spark, an angry teenager with the right combination of anti-Western sentiment and a plausible cover story as an Oregon college student.

In the defense's telling, he was confused, broke and suffering under the weight of parental expectations. Gullible and eager to please, he fell into a plot entirely of the FBI's making, following along with men he imagined were like family, Mohamud's attorneys said.

Mohamud sat still as King read the verdict in a slow, deliberate cadence. His parents, who attended every day of the trial, were absent, leaving the seating reserved for family entirely empty throughout the announcement of the verdict.

After the verdict, the FBI asserted again that Mohamud would indeed have found a way to commit a violent act had agents not intervened.

"Mr. Mohamud made a series of choices over a period of several years ? choices that were leading him down a path that would have ended in violence," said Greg Fowler, who leads the FBI office in Portland. "His actions showed little regard for the rights and responsibilities that come with being an American or respect for the lives that he was prepared to take."

Mohamud's attorney, Steve Sady, later said an appeal was being planned after the scheduled May 14 sentencing.

"We are disappointed with the verdict," Sady said. "We, obviously, thought he was entrapped."

Prosecutors argued that Mohamud was predisposed to terrorism as early as 15 years old. Mohamud traded emails with an al-Qaida lieutenant later killed in a drone strike. He also told undercover agents he would pose as a college student while preparing for violent jihad.

Mohamud was never called to testify. Instead, the jurors saw thousands of exhibits and heard hours of testimony from friends, parents, undercover FBI agents and experts in counterterrorism, teenage brain development and the psychology of the Muslim world.

Assistant U.S. Attorney Ethan Knight told the jury earlier this week that the decision would be easy. Mohamud pressed a keypad button on a black Nokia cellphone and intended to kill people. Whatever else they might think about the methods of undercover agents or the government's decision to investigate a teenager, the underlying decision was Mohamud's and the motivation was hatred of the West.

Sady had argued that Mohamud wasn't radicalized by online recruiters or friends with jihadist leanings, but rather by a Justice Department hungry for convictions that ignored every caution sign along the way. Sady said undercover agents manipulated Mohamud's faith and plied him with praise and the promise of a life leading other jihadis.

"This case has been a difficult case for the city of Portland. It's been a particularly difficult case for Mohamed Mohamud's community, for his family, for the Somali community," said Amanda Marshall, U.S. attorney for Oregon. "We are hopeful that this will bring closure and healing to all of us here in Portland."

Ind. DNR wants charges dropped in deer rescue case

INDIANAPOLIS (AP) ? The Indiana Department of Natural Resources said Friday it is asking a prosecutor to drop charges against a couple who nursed an injured baby deer back to health and kept it in an enclosure on their property for two years.

The misdemeanor charges of illegal possession of a white-tailed deer against police officer Jeff Counceller and his wife, Jennifer, spawned a public outcry. A Facebook page and online petition sprung up in their defense.

Gov. Mike Pence asked the DNR to review the case this week, and on Friday the agency said in a statement that it would ask prosecutors to dismiss the charge, which carries a penalty of up to 60 days in jail and a $500 fine.

The Decatur County prosecutor's office said in a statement that it would review the case once it has received the department's request, but that it had not yet arrived.

"Clearly, this was the right decision. And while we are a state of laws, there is also room for grace, and particularly for people who are trying to care for an injured animal," Republican House Speaker Brian Bosma said Friday.

Jennifer Councellor said she is pleased the agency has reconsidered.

"I had hopes that it would come out this way because it was obvious that much of the world saw the compassion of what we did and there was not criminal intent," she told The Indianapolis Star. The Councellers did not return phone calls Friday from The Associated Press.

Jeff Counceller said he found the deer in 2010 curled up on a front porch with maggot-infested puncture wounds, so he took it back to his family's 17-acre farm in Connersville to try to save it. The couple named the fawn Dani and kept it in a fenced enclosure.

The Councellers said they had intended to release the deer once it was strong enough to survive on its own. They tried to find it a home at animal rescue operations, petting zoos and deer farms, but no one would take it. They applied for a rescue permit but were turned down.

Then, last summer, the deer vanished on the very day the DNR planned to euthanize it. The agency then asked for charges to be brought against the Councellers.

A Facebook profile supporting the couple ? Drop Charges Against Connersville Police Officer ? has drawn more than 38,000 likes, and an online petition calling for the charges to be dismissed has attracted more than 30,000 signatures. The page lit up with triumphant comments following Friday's announcement.

Pence said Wednesday it appeared that conservation officers had properly followed state law barring residents from keeping wild animals. But he also said he had asked the DNR for a briefing and noted that Hoosiers clearly love animals.

The Decatur County Prosecutor's Office, which handled the case because Jeff Counceller is a police officer in Fayette County and works with prosecutors there, urged state officials to review the law.

"We hope that the Department of Natural Resources and the Indiana legislature will take this opportunity to review that statute and decide if matters like these allegations should be handled as crimes or infractions in the future," the prosecutors' statement said.

Brunswick Group?s Michael Buckley, who has been working with Facebook on a range of corporate and other PR issues over the last several years, will be joining the social networking giant as VP of business communications.

Buckley is essentially taking the job held by well-known Washington, D.C., player Joe Lockhart, who left the company last fall.

In his new job, Facebook said that Buckley would be in charge of the company?s international, monetization, corporate, consumer and policy communications.

Buckley has been with the global strategy and communications consultancy Brunswick Group, one of Facebook?s outside agencies, for a decade, most recently as a U.S. managing partner, where he represented a number of clients at once. In tech, that has included Groupon?s Andrew Mason, as well as Mike Lynch of Autonomy, which is battling Hewlett-Packard right now.

Henson Ong, the Connecticut resident and legal immigrant whose passionate defense of the Second Amendment drew applause at a legislative hearing this week, said his pro-gun ownership views were cemented after he and his family were the victims of violent crime in their native land.

Ong, of Waterbury, Conn., said he and his family immigrated to the U.S. from the Philippines 13 years ago. He declined to provide many personal details, including his age, but told TheBlaze in a telephone interview it was that crime that prompted their move to the U.S.

?As a personal victim of violent crime, I can say that appeasement to criminals and disarming the innocent is not the solution,? Ong told TheBlaze. ?If a violent criminal were to attack you and your family, the only answer, the only logical answer, is to defend oneself and eliminate the threat. That doesn?t necessarily mean killing, but it means stop the threat as quickly as possible.?

He added, ?I do not want those rights, and the freedoms that come with the rights, eroded in my adopted country.?

Ong said he felt compelled to testify at the hearing amid nationwide calls for more gun control following the Newtown, Conn. elementary school massacre last month.

?What is the point of gun control? The common factor of all violence in society is the violent individual,? Ong said. ?If the violent individual was not there you could have an arsenal and the arsenal would have harmed nobody.?

He said the Newtown tragedy has been hijacked by people driven by an agenda to restrict gun ownership.

?I believe much of this overreaction is illogical and irrational,? Ong said. ?It is all emotion-based, and it is fanned by people who have an agenda, who have been waiting for an opportunity such as this.?

Ong said the enthusiastic response he got from the audience was an ?encouraging? sign that ?there is more support for freedom against the statist agenda of the current administration.?

?A disarmed population is subject to being victimized by their own government, and by those criminal elements who unfortunately as time goes on becomes part of the government, either directly or indirectly,? he said, referring to government corruption.

?If the population is disarmed, we are helpless. And if the Second Amendment rights are taken away, how long before the First Amendment rights are taken away? How do you enforce the taking away for the Second Amendment without violating the Fourth Amendment?? he asked. ?This is a stand that must not fall.?
